By accessing or using PokeTrace's API services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our API services. This license may be revoked at any time at our sole discretion.

You agree to:

• Use the API only for lawful purposes and in accordance with these Terms
• Not exceed the rate limits associated with your subscription plan
• Not attempt to circumvent any security measures, rate limits, or access controls
• Not use the API to create a competing service or resell data
• Maintain the security of your API keys and credentials
• Not share, transfer, or expose your API keys to unauthorized parties
• Not use automated systems to abuse, overload, or interfere with our infrastructure

API Monitoring:

We actively monitor all API usage for abuse, suspicious patterns, and Terms violations. We reserve the right to immediately suspend or terminate access without prior notice if we detect any activity that we deem, in our sole discretion, to be abusive, fraudulent, or in violation of these Terms.

Access to our Services requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law.

• You are responsible for all applicable taxes
• Failure to pay may result in suspension or termination of your account
• You may cancel your subscription at any time

While we strive to provide accurate and up-to-date Pokemon card pricing data, we make no warranties or guarantees regarding the accuracy, completeness, or reliability of the data provided through our API.

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.

All content, features, and functionality of our Services are owned by PokeTrace and are protected by international copyright, trademark, and other intellectual property laws.

Pokemon and all respective names are trademarks of Nintendo. This service is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokemon Company, or Creatures Inc.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKETRACE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

You may not use our Services to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Distribute malware or harmful code
• Engage in any automated data collection beyond your plan's rate limits
• Attempt to gain unauthorized access to our systems or other users' accounts
• Resell, sublicense, or redistribute our data without explicit written authorization
• Scrape, crawl, or harvest data in a manner that degrades service for other users
• Use multiple accounts to circumvent rate limits or plan restrictions
• Reverse engineer, decompile, or attempt to extract source code from our API
• Use the API in any way that could damage, disable, or impair our infrastructure
• Mask or misrepresent your identity or the origin of API requests

Any violation of these prohibited uses will result in immediate termination of your access without refund and may result in legal action.

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, with or without notice, at our sole discretion. Upon termination, your right to use the Services will immediately cease.

Immediate Termination for Abuse:

If we detect any API abuse, suspicious activity, rate limit violations, or breach of these Terms, we may immediately and permanently terminate your access without prior warning. In such cases:

• No refunds will be provided for any unused subscription period
• Your API keys will be immediately revoked
• We may retain logs and data related to the abuse for legal purposes
• We reserve the right to pursue legal action for damages caused
• You may be permanently banned from creating new accounts

Our determination of what constitutes "abuse" is made at our sole discretion and is final.

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Services after such changes constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PokeTrace operates, without regard to its conflict of law provisions.
